State officials find problems at Mass. pharmacy

BOSTON (AP) ? Water from a leaking boiler collected just outside a room that was supposed to be sterile. Floor mats used by technicians were filled with dirt and debris. Drugs were shipped out before the company even confirmed they were sterile.

State officials said Tuesday that they found these and other problems at the New England Compounding Center during a preliminary investigation into the company, linked to a deadly outbreak of meningitis.

The probe can't yet conclusively prove what caused the outbreak, a top health official said. In the meantime, Massachusetts Gov. Deval Patrick said he wants to tighten oversight at similar companies, including with surprise inspections ? the first of which happened Tuesday.

The state has also moved to permanently revoke the company's operating license, as well as the licenses of its top three pharmacists.

"Those whose laboratory practices caused this outbreak should never practice pharmacy or manufacture in Massachusetts again," Patrick said.

The outbreak of fungal meningitis, an inflammation of the lining of the brain and spinal cord, has sickened 308 people, including 23 who have died, in 17 states. The outbreak has been linked to a steroid made by the NECC and taken mainly for back pain. Compounding pharmacies like NECC custom mix solutions in doses or forms generally not commercially available.

The federal government is conducting a criminal investigation.

The state said Tuesday that its preliminary investigation, which began last month after the company was first suspected in the growing outbreak, found batches of drugs ready for general distribution but not labeled for specific patients.

Its state license permits the company to fill out only specific prescriptions for specific patients, and distributing drugs in batches like a manufacturer would violate that, said Dr. Madeleine Biondolillo, director of the state Department of Public Health's Bureau of Healthcare Safety.

But company attorney Paul Cirel said it's "hard to imagine" state regulators weren't previously aware of the scale of its operations because they've worked so closely together. The state Board of Registration in Pharmacy has always had complete access to the facility, and board members were there as recently as last summer, he said.

"NECC's transparency in dealing with the board since inception in 1998 demonstrates its good-faith intention to operate in compliance with the requirements of its license," Cirel said.

Besides possible state license violations, Biondolillo said the inspections also revealed "several health and safety deficiencies" at the NECC facility in Framingham, just west of Boston.

Three lots of steroids produced by the company are suspected in the outbreak, and the company shipped orders from those lots 13 times before receiving the results of its own tests to confirm those lots were sterile, Biondolillo said. Some medication was shipped as many as 11 days before the company received test results, she said.

Biondolillo also detailed signs of flawed sterilization procedures, including black specks of fungus in sealed vials of the steroids, which were returned to the company during a recall.

Investigators found the company didn't sterilize its products long enough and didn't adequately test whether its sterilization equipment was working, she said.

In addition, mats on which people wiped their shoes to remove contamination before entering a sterile environment were "visibly dirty and soiled with assorted debris," she said. And a leaking boiler adjacent to a pharmacy clean room left an unsanitary pool of water around it and the adjacent walls, she said.

As the investigation continues, Patrick's moves to increase oversight at the state's 25 compounding pharmacies have started.

The first of the unannounced inspections, to take place at least annually, was done on Tuesday, health department spokesman Alec Loftus said. He wouldn't give the inspected facility's name and said the results are being reviewed.

Patrick also said compounding pharmacies will now be required to file annual compliance reports that could help regulators determine if they are acting as manufacturers.

Microsoft tightens rules surrounding customer privacy and personal data collection

Microsoft, the company that has been plagued by security concerns with Internet Explorer in the past, has announced that it would change its new disclosure policy to inform customers explicitly that it will not use personal information obtained from product and service usage. This will protect customers from data being passed onto third-party companies for marketing and advertising.

This action follows a letter sent from Edward Markey, a Massachusetts Democrat and co-chairman of the Congressional Bipartisan Privacy Caucus, to Microsoft CEO Steve Ballmer expressing concern about the policy, which went into effect last Friday. Markey pointed out that Microsoft's new services agreement gave the company leeway to collect and use personal information obtained from consumers of both Hotmail and its recently launched Outlook.com email services.

Microsoft has issued a statement on the matter:

"One thing we don?t do is use the content of our customers? private communications and documents to target advertising.?We could have been clearer about this when we rolled out our updated Services Agreement. We appreciate the feedback we?ve received, and as a result, we will update the agreement as soon as possible to make that point absolutely clear."

According to the New York Times report, the policy provided Microsoft identical rights as Google, which actively scans contents of emails sent through Gmail. We've previously covered Microsoft's humorous Gmail Man campaign, which pokes fun at the search giant's desire to creep through messages sent and received by users. As well as this, Verizon was in the spotlight last week by selling accumulated customer data to third-parties for marketing purposes.

Speaking of Internet Explorer, Microsoft has stated that a "do not track" option will be set as default to true, which will protect users from having web browsing information collected by Microsoft.     Actually is always cheaper to buy your phone on contract on tmobile cause its only $200 to terminate. This means that your getting the phone for roughly $500 and then you can activate it only a monthly 4G plan. Thats is how you save. Also buy your phone at costco, its way cheaper.

    Commentary: Law and Politics: We are a society in crisis - via politics

    No group in organized society has the right to act without regard to the interest of the whole of that society ? and because that is what?s happening, and has been for some time now, we are in the critical state now existing all around us and daily becoming much worse.

    And the horrible incident at Happy Hill Secondary School ? where a young girl stabbed a young man to death inside a class room, for whatever reason ? must convey to those in control, as well as those aspiring to take over the wheels of power, that the whole atmosphere being created by their actions, and their statements as leaders and public figures, must be sending the wrong messages.

    While it is appreciated that political parties are concerned with getting their plans and ideas forcefully into the public arena ? so that at election time the majority will choose the one over the other ? it must also be accepted and fully understood and implemented that no group in organized society has the right to act without regard to the interest of the whole of that society.

    It is understandable and not unreasonable to expect certain groups in society to favour one political party over another, for whatever peculiar reasons they may have in the given circumstances. But at the end of the day, all those who live and work and make some contribution to the operations of that society are entitled to do so in peace, and without undue obstructions from the powers that maybe in control.

    We in these Isles have seen, and encountered, and suffered a whole lot more disadvantages and distresses than all our neighbours in the English-speaking Caribbean, and even further beyond in the wider community.

    But for some strange reasons, we tend to forget so quickly that sooner or not very much later we find ourselves almost back in the same conditions we were so eager to get rid of not so long ago.

    As am writing these comments on 19 October ? that notorious date in our political history way back in October 1983, when the then Revolutionary Prime Minister, the late Maurice Bishop, and seven or so of his loyal cabinet members, were executed on Fort Rupert (now Fort George) in St George?s; and many more of the supporters who followed the cabinet members to the fort ? which housed the headquarters of the PRA ? were also killed, either by bullets or from jumping over the high walls around the fort ? it all comes back to memory as though it was last year.

    And then it was also members of the PRG inner circle ? in rebellion against the leadership of Bishop ? who were doing their own thing in an attempt to take over control of the state of Grenada, Carraicou and Petite Martinique.

    They seemed to have succeeded for a few days, but then the US President Ronald Reagan, in consideration of the US citizens as students of St George?s University, sent in his troops to rescue us all, from prison at Richmond Hill and Hope Vale Camp, and also Grenadians who were prisoners in their own homes, as well as the students.

    The rest is still ongoing history, as some groups and individuals every October keep up the cry for information about the bodies killed on the fort, although the story was they were all burnt at Calivigny.

    But when thinking about crisis in society, the dates and times of 13 March 1979, 19 October 1983, and 25 October 1983 all stand out as historic landmarks that are unbeatable.

    Although the events of those times from March 1979 to October 1983 were far more dramatic and devastating than anything we have experienced since those days of horror, many critics of the last six or so years would still like to argue that we are no better off now than we were then.

    Unemployment and the economy in general are almost at rock bottom, a minority government in control of the nation?s affairs, and the very Parliament that the same revolutionary government had abolished is today suspended indefinitely ? so that no MP or political party could constitutionally challenge or question those in charge of the nation?s affairs in the Houses of Parliament.

    Of course, those in control of the reins of power have a limited time-span to remain in occupation ? but the question begs itself, in that if they decide to go the full term, up to October next year, what would be the state of the economy and thousands of our people living conditions by then?

    By the looks and sounds of possible developments, in the near or more distant future that could make some difference to a few workers livelihood, there are still some hurdles to overcome before any of the projects get underway, so it is not anytime soon.

    And in the current conditions now prevailing island-wide, what are the alternatives facing the people?

    The crisis now existing in the society is affecting a whole lot of people in very different ways ? and a large number of those affected simply do not have the means, or the ability to make any difference.

    And it is precisely because of that shortcoming, in so many of the victims as it were, that even those who can make ends meet to ease the pressures and the burdens are becoming possible victims, because of the frustration of the helpless ones who are unable to cope.

    Some things have to give way or someone or group or institution must intervene to bring about a much speedier solution to this impasse that those now in control seem bent on prolonging for as long as they have some authority so to do.

    A lot of onlookers can see why the desire to stay in control up to the bitter end, because they feel time will help them to get one or two projects on stream, and in so doing that will persuade many doubters to choose the same team again, albeit with many new faces to replace those expelled.

    But in my humble opinion, and from talking with a whole lot of concerned citizens, who are under serious pressure to make the scarce dollars meet their needs, getting the one or two projects on stream will make no difference, to the feelings built up over the past four years when very little was seen to get done.

    The feelings seem to be much more in favour of ending the current pressure as soon as possible, and giving people the freedom to choose a new team as they see fit ? and keeping the projects on hold to begin the next term, should they be successful at an earlier polls.

    As we come to the anniversary of October 25, 1983, when the US forces came to our people?s rescue from house arrest, and detention at Richmond Hill Prison and Hope Vale Camp, it all seems in 2012 like it was 29 years ago, when the very few with power had control over the great majority for four-and-a-half years, and had to be removed by force.

    The crisis we are now facing is hurting a whole lot of innocent people ? but we just have to wait and hope that good sense and belated care and concern would sooner rather than later come to our people?s rescue.

    NEW STUDY: Higher growth for small businesses who embrace e ...

    In 2012 its amazing to still learn that many businesses are yet to embrace online as part of their marketing and sales strategy. A recent survey by Hunter Valley Research Foundation revealed that many Hunter businesses are not embracing the digital economy with rates of taking orders via the internet remaining very low and 42.7% of businesses having no website.

    One in three small businesses have made their products available for purchase online and those that have are reaping the benefits, according to a nationwide survey.

    Commissioned by American Express among more than 1000 Australian small business owners, the survey shows that those who have embraced e-commerce are 33 per cent more likely to have reported a profit increase in the 2011-12 financial year.

    Those small businesses who have introduced e-sales say it accounts for almost half (45 per cent) of their revenue and the majority (55 per cent) predict an increase in this type of trade in the next 12 months.

    ?Small business owners who have incorporated e-commerce into their business are seeing it as a worthwhile investment and appear confident of its long-term benefits. This comes at a time when having an online presence is becoming more and more important for small businesses. In fact, Australian business owners cite company websites and Facebook pages as the most effective marketing channels,? said Amelia Zaina, Head of Marketing and Customer Engagement, Small Business Services at American Express.

    Social media drives revenue growth

    The American Express survey also found that social media has helped almost one quarter (23 per cent) of small business owners to grow their business ? and those that attribute business growth to social media are more likely to have reported an increased profit in 2011-12 (57 per cent) than those who don?t (35 per cent).

    Small business operators who use social media believe it has helped them grow their business in several ways, including:

    • Sourcing new customers (54 per cent);
    • Raising brand awareness (51 per cent); and
    • Generating new sales (40 per cent).

    ?These findings support the notion that small businesses who have gone online and are using social media, are seeing comparatively stronger revenue growth? Zaina said.

    ?While different channels work better for different industries, both e-commerce and social media can be innovative and affordable. Businesses can benefit in many ways to offset the impact of tough economic times on their business.?

    Non-embracers reluctant to introduce e-sales

    Despite the success of e-commerce, those who have not established an e-sales strategy are reluctant to do so, with only 12 per cent planning to sell their products and services online in the next 12 months. An even smaller number of small business owners (9 per cent) consider e-commerce necessary for future-proofing their business.

    This reluctance can partly be explained by the significant proportion of respondents (40 per cent) who don?t find e-commerce relevant to their business ? a view most prevalent among those in construction, finance, insurance and health and community services.

    ?Some small business owners also say they are not sure how to approach adopting e-commerce with their main concerns surrounding difficulties in setting up the payment platform and customer privacy issues. Seeking out information and advice on how to do this could potentially benefit their business and allay any concerns they may have,? said Zaina.

    ?Fortunately for small business owners, the internet offers limitless opportunities so even those who feel e-commerce isn?t right for them can make use of the online opportunities offered by social media to promote their products and grow their business.

    Pope Benedict names first Native American saint

    Kateri Tekakwitha was named the first Native American saint today by Pope Benedict XVI in a ceremony held in St. Peter's Square.

    Some 80,000 people came to the open-air ceremony as the 17th century Mohawk-Algonquin woman and six others were canonized.

    "It's so nice to see God showing all the flavors of the world," Gene Caldwell, a Native American member of the Menominee reservation in Neopit, Wis., who attended with his wife, told the Associated Press. "The Native Americans are enthralled."

    The canonization ceremony happened at the same time the world's bishops descended on the Vatican to discuss ways to revive faith in parts of the world where it is falling by the wayside.

    Among some of the select faithful who were chosen to receive communion from the pope was Jake Finkbonner.

    The Washington boy was near death for months with a flesh eating bacteria, but made a miraculous recovery that the Vatican credited to Tekakwitha.

    The Vatican said it believes that the prayers Finkbonner's family directed to Tekakwitha were responsible for bringing the boy back from the brink of death.

    Finkbonner cut his lip during the last minute of a Boys & Girls Club basketball game in 2006.

    "I was running down court with the ball, I stopped in front of the hoop to shoot when I was pushed from behind," Jake wrote on his website. "I flew forward and hit my mouth on the base of the portable basketball hoop."

    Two days later, he wrote, he was in the hospital with a strep bacteria infection that had spread across his face, head and chest.

    "It's a bacteria that can cause severe infections in unusual circumstances but most of us don't ever have any problems with it," said Dr. Christopher Ohl, a doctor at Wake Forest Baptist Medical. "But if all of the circumstances come together and the setting is just right, it can get in through the skin and cause a severe infection."

    Ohl said the chance of survival for people with the bacteria is roughly 50-50.

    At the urging of the family's priest, the Finkbonners began praying to Tekakwitha, who converted to Christianity when she was 18 and became a fervent follower.

    Her face was scarred by smallpox as a child, but it is claimed that the scars disappeared after she died in 1680 at the age of 24.

    'Argo' is one of the best movies of the year.

    Argo has that solid, kick-the-tires feel of those studio films from the 70s that were about something but also entertained. Only it's as laugh outright amusing as it is sobering.

    The movieland satire is laid on thick, but it's also deadly accurate. Schlock has never seemed so patriotic, and Arkin and Goodman have rarely been so good.

    Argo is a rollicking yarn, easily the most cohesive and technically accomplished of Affleck's three films so far, but a part of me wishes the director hadn't cast himself in the lead role.

    If nothing else, it proves that every so often, the CIA can pull something off - and that yes, Canadians are just about the nicest people on the planet.

    The film is a whopper of a tale, one designed for Oscar nominations, Best Picture and Best Director among them.

    Boy Scout files show nearly 20 sex-abuse cases with New Orleans ...

    More than 70 Louisiana cases are listed among the "perversion files" -- a vast,?long-secret collection of documents chronicling?men cast out of the Boy Scouts of America?over the past six decades because, in many cases,?they were suspected of being child molesters. Nearly 20 of the cases have a connection to New Orleans -- a city particularly salient in the history of the Scouts as the site of the organization's first well-known?sex-abuse scandal 36 years ago.

    The confidential files, kept secret for?decades in the Boy Scouts' Texas headquarters, were compiled in a database released Thursday by the Los Angeles Times.

    That newspaper's investigation found that, across the country, the Scouts sometimes "failed to report abuse to authorities and many times apparently covered up allegations to protect the organization's reputation." The Scouts issued an apology Thursday for past actions.

    In New Orleans, the documents available in the database do not indicate that the local Scouts actively attempted to hide abuse. Rather, they suggest that the organization?reacted to criminal charges already filed against Scoutmasters and volunteers, and looked to minimize media coverage of the events.

    But dozens of cases on the list do not include names or documents, so they do not indicate what the allegations entailed and what the Scouts did or did not do to protect the children involved. Those cases are listed in the database only by an identification number, the city and the troop number.

    At least 19 cases, dating from between 1962 and 1999, are connected to the New Orleans metropolitan area, with another 51 cases in other parts of the state.

    Only five men from the New Orleans area are listed by name. One, an example?of a small percentage who were?expelled for suspicion of homosexuality and not child molestation, was booted?out in 1972 after a police report surfaced from five years earlier, accusing him of crime against nature for attempting to have oral sex with an undercover police officer.

    Three others on the list became familiar names in media reports?in the late 1970s and early 1980s. Raymond Woodall, Richard Stanley Halvorsen and Harry Cramer were among 17 people arrested in 1976 in the "Boy Scout sex case" that shook the city and tarnished the Scouts' local reputation for years?to come.

    The men, along with?Lewis Sialle, who was not named in the Scouts' files, decided in 1974 to found a Boy Scout unit, Troop 137 in eastern New Orleans, in order to "provide them with boys ... for their sexual pleasure," Sialle later testified.?

    In September 1976, an employee at a commercial photo developer processed a roll of film containing 18 pictures of a 15-year-old boy being raped by his Scoutmaster and his adult friends.

    Police said they learned that the group had recruited poor children from broken homes -- a tactic consistent with the Los Angeles Times' analysis of the Scouts' files from across the country. They bought the boys' affection with bicycles and uniforms and invited them?to? "sleepovers" and naked pool parties, another nationwide trend the California newspaper discovered.

    Troop 137, authorities learned, "was the nucleus of a nationwide sex and pornography ring, with boys recruited into the troop sent to other states for the pleasure of the men there," according to a Times-Picayune report on?the trials.

    Seventeen adults were arrested, including the four New Orleans Scout leaders, a Tennessee minister who ran a home for wayward boys, an official from a Florida school for children with learning disabilities, a prominent New Orleans landscape painter and a Boston millionaire.

    The media dubbed it the "Boy Scout sex case."

    In November 1976, two months after the case first?made headlines,?a local Scouting official wrote to the national?office, according to documents?in the Los Angeles Times' database. "Proof of immoral acts against Woodall and Cramer were shown to me by the New Orleans Police Department with pictures. I have not seen any pictures on Halvorsen, however he seemed to be one of the ringleaders," the local executive wrote.

    The national office responded the following month, requesting letters from those involved, newspaper clippings and court records. "This information is important for future reference purposes and would certainly strengthen our position of refusing to accept any future applications for registration we might receive from these men," an official wrote. "Unless we receive the above-requested material, it will be difficult to place these men on the Confidential File."

    Woodall, an assistant Scoutmaster, was sentenced to 75 years; Halvorsen, the Scoutmaster,?to 30 years; Cramer, an assistant Scoutmaster,?to 45 years; and Sialle, an official on the troop committee,?to seven years.

    The local Scouts were still struggling for recruits?a decade later, in 1987, when a 33-year-old Boy Scout camp employee named Steve Allen Adams told a 15-year-old Scout that he needed an "attitude adjustment." They were at a camp near Kiln, Miss., that was run by?the New Orleans Council.

    Adams allegedly rubbed the boy down, then lured him to a remote area "for additional fun." He fondled the boy and forced him to perform oral sex on him. He was arrested in the summer of 1987.

    A New Orleans Area Council executive "is well aware of the very serious morals situation in New Orleans Council a decade ago, which he says still is a handicapping stigma to the council there,"?national Scout officials wrote in their secret files, which were part of the collection made public Thursday. "He says things are 'very fragile' and fears any media exposure will be a disaster to Scouting locally. He is hoping if and when charges are filed that they may not come to the media's attention."

    The case did come to the media's attention?and was widely reported.

    The "perversion files" are?one of the more comprehensive collections of child sexual-abuse cases ever compiled. They were meant to permanently ban suspected child abusers from the organization.

    But the Los Angeles Times' investigation found that the collection also chronicled patterns the Scouts shared with the?Roman Catholic Church and Penn State abuse scandals of recent years, including the organization's failure to report hundreds of cases of alleged abuse to police, and often hiding of allegations from parents.

    In 80 percent of 500 cases across the nation where the Scouts were the first to learn of suspected abuse, the Los Angles Times reported, there is no record that the information?was ever forwarded to police.

    Since the newspaper's initial story in September, the Scouts pledged to review around 5,000 files and alert law enforcement to any cases that had not been previously reported.

    The Times compiled the database from court files and dossiers provided by Oregon attorney Timothy Kosnoff, who has sued the Boy Scouts more than 100 times. It includes about 5,000 cases, the entirety of the Scouts' surviving files, though an unknown number have been destroyed.

    The latest batch of 1,200 cases was released Thursday by Oregon attorney Kelly Clark, who represented a victim in a 2010 case and won a $20 million judgment against the Scouts. The Oregon Supreme Court, urged by several media organizations, ordered the files released.
