PFT: Lions offer Reggie Bush the starting job

On the day that he lost his job as quarterback of the Bills, Ryan Fitzpatrick said the reason was simple: The NFL is a results business, and the Bills didn?t get results during his four seasons in Buffalo.

Asked on WGR 550 whether he has any regrets about his tenure in Buffalo, Fitzpatrick said he feels badly not only about losing his own job, but about not being able to save the job of the head coach who put so much faith in him, Chan Gailey.

?I don?t know if regret is the right word, but the biggest thing is the fact that we didn?t get it done the last few years,? Fitzpatrick said. ?With Chan, his whole staff being let go after the season. That was a guy that gave so many people on this roster right now opportunities to play and to shine and guys have stepped up and took advantage of opportunities. The fact that we weren?t able to win, not only to win for the city of Buffalo because they certainly deserve it, but for a man like Chan, that?s probably something I was most disappointed that I couldn?t do a better job of that, a better job of bringing in more wins for a guy that put a lot of faith in me.?

Still, Fitzpatrick said there were good times as well, particularly the win over the Patriots in Week Three of the 2011 season, which made the Bills 3-0.

?I?ve got so many good memories,? Fitzpatrick said. ?The first one playing wise that popped in my head is when we beat New England and just kind of the way the fans had reacted to that victory. The fever within Buffalo, I mean all that was really cool.?

Fitzpatrick also talked about his ?FitzScream? after beating the Raiders in Week Two of 2011.

?That was just pure and utter joy. That was, I don?t know, unbridled enthusiasm,? Fitzpatrick said.

Unfortunately, after the unbridled enthusiasm of the Bills? 3-0 start in 2011, they lost 20 of their next 28 games. That?s what led to Ryan Fitzpatrick?s downfall.

PFT: Flacco says Boldin should 'stick to his guns'

Vikings receiver Percy Harvin reportedly wants out of Minnesota.? He also reportedly wants to be paid like Lions receiver Calvin Johnson.

But Harvin is overlooking one important reality.? He?ll have to find a team that wants him, and a team that will pay him what he wants.

As one NFL front-office source explains it, Harvin and his agent forget that a large portion of the league had him off of their draft boards in 2009, due to his reputation for being a pain in the posterior.

In Minnesota, the Vikings have done a nice job of keeping Harvin from being too much of a problem, at least publicly.? Under former coach Brad Childress, then-defensive coordinator Leslie Frazier often was the peacekeeper.? Now that Harvin and Frazier reportedly had a ?heated exchange? that preceded Harvin?s placement on injured reserve, Harvin may be out of allies in Minnesota.

That doesn?t mean he?ll have friends elsewhere.? Especially if he gets the kind of money he wants.? If/when (if) he cashes in, Harvin will be largely untouchable, free to do what he wants, how he wants, when he wants.

Even though there are plenty of desperate coaches and General Managers in the NFL, there?s a difference between desperation and stupidity.? For Harvin, the key word could be delusion.

If there?s no team who will both trade for him and pay him, he?ll continue to be the property of the Vikings.? And the manner in which he handles himself during the final year of his contract will go a long way toward shaping the extent to which other teams will, or won?t, be interested in him once he hits the open market.

And if he decides to hold out, the Vikings can fine him hundreds of thousands of dollars and, if he doesn?t show up by Week 10, squat on his rights through 2014.

California Court Addresses Priority of Coverage In Auto Context ...

In the recent case GuideOne Mutual Insurance Company v. Utica National Insurance Group (4th Appellate Dist. 2/28/13), the California Court of Appeal considered priority of coverage among primary and excess insurers following settlement of a serious bodily injury claim from a car versus motorcycle accident. The accident case settled for $4.5 million and the coverage action was subsequently filed to reallocate the settlement payments.

The driver of the car was a pastor for Crosswinds Community Church, which operated under the oversight and control of an organization referred to as CEA. The accident happened during the course of the pastor?s work for Crosswinds. The pastor?s personal auto insurance policy, which specifically identified the subject car as a covered auto, paid its $100,000 policy limits toward the settlement. GuideOne insured Crosswinds under a commercial general liability policy which also covered the pastor as Crosswind?s employee acting in the course and scope of employment. GuideOne paid its $1 million primary policy limits and its $1 million umbrella policy limits. Utica National Insurance Group and its affiliate (referred to collectively by the court as ?Utica?) covered CEA under a commercial auto policy (and its umbrella policy) for liability as to covered autos, which included nonowned autos. Utica paid its $1 million primary policy limits and $400,000 out of the $5 million umbrella policy limits.

GuideOne subsequently sued Utica for contribution from the umbrella policy, seeking reallocation of the settlement shares based on a ratio as to the respective coverage held by the insurers, as was the sharing formula provided for in the other insurance clauses of each policy. The trial court found in favor of GuideOne on its motion for summary judgment, holding that it was entitled to contribution in the amount of $600,000.

Utica argued on appeal that GuideOne?s policies were primary to both of Utica?s policies because GuideOne insured the pastor, the tortfeasor, while Utica?s policies insured an entity which was only vicariously liable. The court of appeal agreed with that argument.

The appellate court found that the statute dealing with priority of coverage, Insurance Code ?11580.9(d), only established that State Farm was primary because it specifically scheduled the car as a covered auto, and the other four policies were excess. The priority of coverage for the remaining policies was not subject to the conclusive presumption in ?11580.9(d). In reversing the trial court, the court of appeal relied on the decision in United States Fire Ins. Co. v. Nat. Union Fire Ins. Co. (1980) 107 Cal.App.3d 456, which held, in an airplane accident case, that insurance covering the negligent pilot was primary to insurance covering the pilot?s vicariously liable employer. The U.S. Fire court looked to general principles of indemnity law which says an employer liable for the negligent acts of his employee is entitled to indemnity from the employee A Ninth Circuit Court of Appeal case, Canadian Indem. Co. v. U.S. F&G Co., 213 F.2d 658 (9th Cir. 1954) held similarly.

GuideOne argued that neither of those cases involved Ins. Code ?11580.9(d) nor did they involve excess policies. The court of appeal rejected that argument, pointing out that ?11580.0(d) did not apply by its terms, and both GuideOne?s primary and excess policies covered the negligent driver and both of Utica?s primary and excess policies covered the employer who was only vicariously liable. The court also noted that GuideOne?s policies both covered CEA for its vicarious liability.

(AP) ? The United States and China have reached agreement on a new draft sanctions resolution to punish North Korea for its latest nuclear test, U.N. diplomats said late Monday.

The U.N. Security Council announced late Monday evening that it will hold closed consultations on North Korea and non-proliferation at 11 a.m. (1600 GMT) Tuesday. The diplomats, speaking on condition of anonymity because no official announcement has been made, said the United States is expected to circulate a draft resolution to the full council at the meeting. Council members are then expected to send the draft to their capitals for review.

All 15 council members approved a press statement condemning Pyongyang's nuclear test and pledging further action hours after North Korea carried out its third atomic blast on Feb. 12.

The swift and unanimous response from the U.N.'s most powerful body set the stage for a fourth round of sanctions against Pyongyang.

For the last three weeks, the United States, a close ally of South Korea and Japan, has been negotiating the text of a new resolution with China, North Korea's closest ally.

Russian U.N. Ambassador Vitaly Churkin, whose country holds the council presidency this month, told a news conference Monday that a resolution on North Korea might be approved in March though the text had not yet been circulated.

Last month's statement from the Security Council called the underground test in February a "grave violation" of three U.N. resolutions that ban North Korea from conducting nuclear or missile tests.

North Korea's three nuclear tests ? in 2006, 2009 and 2013 ? occurred after Pyongyang was condemned by the United Nations for rocket launches.

The Security Council imposed sanctions after the first two nuclear tests and after the North's rocket launch in December, which was viewed as part of the country's covert program to develop ballistic missiles that can carry nuclear warheads.

The sanctions are aimed at trying to derail the country's rogue nuclear weapons and ballistic missile programs. They bar North Korea from testing or using nuclear or ballistic missile technology, and from importing or exporting material for these programs.

The latest sanctions resolution, adopted in January, again demanded that North Korea abandon its nuclear weapons program and cease missile launches. It slapped sanctions on North Korean companies and government agencies, including its space agency and several individuals.

The diplomats said they did not know what new sanctions would be included in the resolution to be circulated Tuesday.

There has been speculation that a new resolution will strengthen existing sanctions related to North Korea's nuclear and missile programs, toughen financial restrictions and cargo inspections, and add additional companies and individuals to the sanctions list.
